What will happen when I remortgage?
You need a remortgage solicitor when you’re changing the mortgage on your property and moving to a new lender. Perhaps your fixed-term mortgage has come to an end, or you’re switching to find a better remortgage deal.
Once you have your remortgage “offer in principle,” and you’ve applied for the new mortgage, the next step will be to find a reliable solicitor who can help you through the process. Your conveyancing solicitor will need to do identification and anti-money laundering checks to meet their regulatory obligations. This will involve verifying your identity and confirming your source of funds. You’ll be asked for ID documents and income documents too.
We’ll ask you for all the account details for your current mortgage and property, which we will use to request the title deeds from the Land Registry and a redemption statement from the lender. The redemption statement will outline how much is left to pay on the existing mortgage and whether any extra fees will be incurred, such as if you are leaving the mortgage early. The title deeds will confirm that you are the property owner.
Your conveyancing solicitor will do local authority searches to check the land and surrounding areas for things like mining and contamination, although this can be covered by search indemnity insurance.
The home will be valued by the lender to determine the market value and ensure the property has enough equity to allow for a remortgage. After this, they will make a formal offer of a remortgage. Your remortgage solicitor will receive the mortgage offer from your lender, and they will check through the requirements and advise you of any conditions.
Providing you’re happy with all the requirements and conditions, you’ll be asked to sign the mortgage documents to agree to the remortgage.
Your property solicitors must then do a bankruptcy search and a Land Registry priority search. The bankruptcy search ensures that you or any other legal owners are not bankrupt and the priority search prevents other charges from being made on the property. It also confirms that the title cannot be changed until after the remortgage process has been completed.
Your conveyancing solicitors will send a certificate of title which is only submitted to the lender once your solicitors confirm that all the lender’s conditions can be met and the remortgage funds released. After this, the remortgage will be registered with the Land Registry and you’ll receive copies of the documentation.
